the answer was in the first phrase of the paragraph 1.3
In a hex, each side can have up to: 3 squad, 2 SMCs and 2 vehicles.
Just a little word which makes a huge difference. I should have read this paragraph more carefully

there is another way to visualize the situation. Example 5 , the two squads have their feet on the ground floor (level 0) and their eyes at the level 1.

OK on the last rules version 5 page 17 says :"Heroes (11.2) firing a SW forfeit their IFP."
So they shall not use their IFP so my situation shall be resolved with
2MF then throwing the satchel with D6+6FP
